1. AGREEMENT AND FEES

This Agreement between the Member and Canna Kush (“The Club”) is on an annual membership basis.

The annual membership fee is R120, payable in advance.

Membership fees will be reviewed annually, and the Club will provide written notice of any adjustments prior to implementation.

2. MEMBER OBLIGATIONS

The Member agrees to comply with all current and future rules and regulations set by the Club, including but not limited to the Club Code of Conduct and Club Constitution, which are published on the website, posted in any Club premises, and provided in writing upon signing this Agreement or via notice pursuant to Clause 8.

The Member acknowledges receiving mandatory educational material on the safe and healthy consumption of cannabis.

The Club reserves the right to revoke this Membership Agreement if the Member breaches any rules and regulations or engages in nuisance, disturbance, moral turpitude, or fraud, as specified in the Club Constitution, by giving notice in accordance with this Agreement.

The Member guarantees not to undertake any actions that may end, limit, or revoke their constitutional right to cultivate cannabis as per the Constitutional Court ruling of September 2018, including any cannabis cultivation activities outside the Club's guidelines.

3. CODE OF CONDUCT

In addition to obeying the Club's rules and regulations, the Member agrees to:

• Be at least 20 years old.
• Hold only one membership per legal person older than 20 years.
• Be a cannabis enthusiast interested in the educational, medicinal, and recreational benefits of cannabis and its promotion.
• Undergo vetting and verification for criminal records and financial soundness.
• Be a free-minded, free-thinking, self-sustaining individual.
• Participate in an annual volunteer program for cannabis education and advocacy.
• Refrain from buying, selling, or trading cannabis provided by the Club.
• Understand that membership and access to cannabis or related products cannot be granted on the same day.
• Keep all personal details up to date.
• Allow the Club to retain 25% of all harvests as a buffer for future crop failure, Club events, and research and development of new products.

4. CLUB OBLIGATIONS

The Club will maintain its purposes in accordance with the Club Constitution and Rules for the benefit of its Members.

The Club will use all reasonable efforts to provide the Member with a minimum monthly allocation of cannabis.

5. DISPATCH REQUEST, AUTHORIZATION, AND CONFIRMATION OF APPOINTMENT OF AGENT

The Member confirms that once a member of Canna Kush, they will own the property stored in a communal locker at Canna Kush.

The Member appoints a Canna Kush representative as their exclusive agent to manage their property per the property label awarded to the Member, including:

1. Accessing their locker;
2. Handling their property;
3. Removing and packaging 100 grams of their property;
4. Sending the property via courier service;
5. Storing the remainder of their property.

6. NON-TRANSFER

This Agreement is not assignable or transferable by the Member, and no rights or privileges granted may be transferred or assigned.

7. NOTICES

All written notices and communications between the parties are valid if served via WhatsApp.

8. TERMINATION

The Club may terminate this Agreement for cause or by giving 1 month’s written notice to the Member.

The Member may cancel this Agreement by giving at least 1 month’s written notice to the Club, pursuant to Clause 8.

The Member acknowledges receipt of this Agreement, executed by both parties, and agrees to its terms.
